These Terms of Use set forth certain rules and policies that govern the use of this St. Francis Homes Association (“SFHA” or the “Association”) website (the “Site”), and therefore it is important that you read these Terms of Use carefully. By using this Site, you, agree to be bound by the Terms of Use below and you represent and warrant to the Authorization that you are authorized to be bound by these Terms of Use, both personally, and on behalf of any legal entity of which you are a representative, agent or employee, when you are acting in such capacity as a representative, agent or employee. Please note that because these Terms of Use are subject to change, we advise you to read these Terms of Use regularly. If you continue to access and use this Site after changes to the Terms of Use are posted, your use shall be deemed to constitute acceptance of all revisions. It will be your responsibility to review this page for possible modifications. If such communication or information is confidential or proprietary, you should not transmit it though this Site.

The Association makes no guarantee that any complaints, maintenance requests, or other communications with the Association or its board of directors transmitted through this Site will successfully reach their intended recipient or be acted upon, and the Association is not responsible for any losses, damages or liabilities of any kind resulting there from.

This Site contains information, software, photographs, text, Association documents, video, graphics, links and other material (collectively, “Content”) supplied by the Association. The Site provides access to Content that is legally protected by us and others under patent, copyright, trademark and other intellectual property laws. You agree to comply with all copyright notices and other restrictions contained in any Content available on, or accessed through, the Site. YOU ALSO AGREE TO USE THE CONTENT ONLY FOR PERSONAL PURPOSES.

ASSOCIATION DOCUMENTS

The Association documents which may be accessed from this Site are made available as a convenience to Association members. Members are cautioned that the Association does not make any warranty or guarantee as to the accuracy, completeness or currentness of the documents made available on this Site. It is not intended that the Association documents made available on this Site be utilized by homeowners Associations other than the Association.

We may provide links to other websites or resources, which are owned and operated by other parties. We are not responsible for the availability of these sites or any of the Content contained on them. Your linking to or from any third-party website pages or other websites is at your own risk.

 

MISCELLANEOUS

These Terms of Use shall be governed by the laws of the State of California, without giving effect to its conflict of laws provisions. You agree that any legal claims relating to these Terms of Use must be brought in the courts located in San Francisco County, California. If any portion of these Terms of Use (or other terms and conditions applicable to a section of this Site) is found by a court of competent jurisdiction to be invalid or otherwise unenforceable, it shall be deemed amended in order to achieve as closely as possible the same effect as originally drafted. Any invalid or unenforceable portion should be construed as narrowly as possible in order to give effect to as much of the Terms of Use as possible. Any unaffected provision of these Terms of Use shall remain in full force and effect.

The Association respects your privacy. The aim of this privacy policy (this “Privacy Policy”) is to describe how and why we collect your personal data.  We will also inform you of what we do with this data, with whom we share it, how we protect it and the choices you can make.

This Privacy Policy applies only to the processing of your personal data in the framework of this website and actions targeting users of this website which are provided or operated by us or on our behalf. This Privacy Policy does not apply to the privacy practices of companies we do not control, nor to any information obtained or collected in connection with a separate relationship with the Association or our affiliates. This Privacy Policy also contains general rules and explanations regarding this processing.

 

INFORMATION WE COLLECT

When creating an account through the Site, we require you to provide us with certain personal contact information including name, address, phone number and email address (“Member Information.”) Member Information that you provide to us will be used so that we may respond to your inquiries, send you Association communications and update homeowner records for annual dues and other Association responsibilities.

The Association may also collect information during your visit to the website through automatic data collection tools, which may include cookies (see below for more information on cookies) and other commonly used information-gathering tools. These tools collect certain information that your browser sends to our website such as your browser type and language, access times, and the address of the website from which you arrived at the SFHA website. We do not sell or rent Member Information for valuable consideration. We may disclose it to the following categories of recipients, which will then process your personal data only within the framework of these purposes:

• authorized staff members of the Association or FirstService Residential.

• third parties that provide services for or on behalf of the Association or FirstService Residential.
